Acceptance: These Terms and Conditions shall govern all contracts for the sale of any goods to Buyer by Brown’s Dump Bodies and/or its subsidiaries and divisions (collectively "Seller"). These Terms and Conditions shall control over any conflicting terms and condition set forth in any request for quotation, purchase order, confirmation or other transaction document submitted to Seller by Buyer.
Taxes and Other Charges: Buyer shall be responsible for paying any taxes, duties, fees, or other charges imposed by any governmental entity based upon Buyer’s purchase of any goods from Seller.
Payment: Buyer shall pay Seller’s invoices within thirty (30) days of receipt. Buyer agrees to pay interest to Seller on any past-due amounts. Unless other terms are stated
Paint: Brown’s painting practice is to paint the underside of the body black regardless of body color. Body color will be painted on the exterior of the body and on the inside only a short distance from the top.
Maintenance: Within the first week of use, recheck the installation of the PTO / pump. Check for leaks and loose mounting hardware (bolts, nuts, studs). Recheck any cable or lever connections for proper adjustment and tighten any loose connections. At regular maintenance intervals check adjustment and lubricate moving parts, tighten and repair the connections, mounting hardware, cable or lever linkage. Failure to follow maintenance procedure can result in non-warrantable failures.
Pumps and PTOs: If trucks are prewired for a PTO Browns should be made aware at the time of order, wires must be clearly marked and easily located. Any computer parameters / programing will need to be factory set for PTO, Transmission, and Engine compatibility for the application. If further programing is needed this will be the buyers responsibility.
Limited Warranty: Brown’s Dump Bodies warranty period is 1 year from the sale to the end user/customer and warrants that seller’s product shall be free of defect in material and workmanship under normal operating conditions and when properly maintained and operated as intended.
Warranty Procedure: Any and all clams must receive prior approval form Brown’s prior to any work. Repair, replacement, or credit is at Brown’s discretion and will not be reimbursed for work performed without prior authorization. Brown’s reserves the right to refuse estimates deemed excessive.
Delays in Delivery: Seller shall not be responsible for any delay in delivery of goods to Buyer due to fires, strikes, riots, Acts of God, government orders or restrictions, delays in transportation delays by suppliers or materials or parts, inability to obtain necessary labor or other causes beyond Seller’s control. In the event of such delay, the delivery date shall be extended for a reasonable period of time.
